Terms of Service for aSeller POS Platform

1. DEFINITIONS

"Service" – The aSeller sales management software accessible via the domain aseller.vn, subdomains, and official aSeller mobile applications.

"aSeller Management App" – The official mobile application on iOS and Android operating systems downloaded directly from Google Play or the App Store.

"aSeller Staff App" – The official companion application for waitstaff and cashiers on iOS and Android operating systems downloaded from Google Play or the App Store.

"Website" – The electronic website located at the address aseller.vn.

"Content" – Graphics, logos, text, articles, user interface designs, and multimedia materials published on the Website.

"Account Owner" – The individual or legal entity that originally registered the store account; the administrator holding master access credentials.

"Administrator Account" – The primary account created when the Account Owner establishes a store on aseller.vn.

"You" – The Account Owner, authorized store employees, or website visitors exploring the aseller.vn portal.

"aSeller" – Owned, maintained, and operated by XGIT Digital Technology Co., Ltd.

"Third Party" – Customers, vendors, hardware providers, or integration partners of the store or aSeller.

"Store Data" – Electronic data, inventory catalogs, transaction records, customer profiles, and financial metrics stored within the store workspace.

"Public Area" – The homepage, login screen, footer, and branding areas visible without authentication.

"Private Area" – The password-protected store POS console, inventory management screen, and reporting dashboards.

"Features" – Capabilities and software tools provided by the aSeller platform.

2. SCOPE OF APPLICATION

These Terms of Service govern your use of the aSeller management platform, official server instances, and mobile applications.

By accessing the Website, downloading the apps, or creating an account, You acknowledge that You have read, understood, and agreed to be bound by these Terms of Service. aSeller reserves the right to amend or update these terms at any time. Continued use of the Service following revisions constitutes acceptance of the updated terms.

You agree to utilize the Service solely for legitimate commercial business purposes in full compliance with applicable laws, regulations, and public standards. aSeller commits to protecting your Store Data with strict confidentiality and will never disclose your business information to third parties without prior authorization, except where mandated by law.

6. INCIDENT REPORTING AND SUPPORT

You agree to notify aSeller immediately upon identifying system errors, unexpected service disruptions, or security vulnerabilities, and to cooperate with technical engineers to resolve issues expeditiously.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, aSeller shall not be held liable for damages, lost profits, or data corruption caused by:

1. Unauthorized server intrusion resulting from external force majeure or third-party device vulnerabilities.
2. Hardware failures, printer incompatibility, or local network outages beyond aSeller's reasonable control.
3. Third-party external services (such as banking payment gateways or SMS providers) linked to the platform.
4. General commercial outcomes, business profitability, or tax compliance of your store operations.

8. SERVICE AVAILABILITY

The Service is provided on an "as-is" and "as-available" basis. While aSeller makes continuous efforts to maintain 99.9% uptime, we do not warrant that the Service will remain entirely uninterrupted or error-free at all times. Scheduled maintenance will be announced in advance when feasible.

9. USER GUIDES AND DOCUMENTATION

User guides, setup tutorials, and hardware connection manuals are accessible at the Help Center. Setup instructions are also provided in the welcome email upon account registration.

10. USE OF PUBLIC AREAS

aSeller retains sole discretion over the operation, branding, and publication of the Public Areas of the Website and mobile applications.

11. USE OF PRIVATE AREAS

You hold exclusive control over your password-protected Private Areas. You are responsible for all actions taken and data inputted within your store workspace.

12. ACCESS TO PRIVATE AREAS BY ASELLER

aSeller may access your store workspace strictly under the following conditions:

• With your explicit consent, to deliver technical assistance or resolve customer support tickets.
• At your formal request.
• Under emergency circumstances, to mitigate security threats, system-wide crashes, or malicious external intrusions.

13. OFFICIAL COMMUNICATIONS

Official automated transactional notifications and billing receipts are dispatched solely from [email protected] or @aseller.vn domains. Notifications from alternative sources should be treated with caution.

14. TRADEMARKS

The "aSeller" name and logo are registered trademarks. You may not register or utilize identical or confusingly similar trademarks, logos, or commercial identifiers.

15. SEVERABILITY AND PREVALENCE

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect. In the event of a discrepancy between these Terms and a separately executed written Master Services Agreement, the most recent agreement shall prevail.

16. ADDITIONAL TERMS FOR MOBILE APPLICATIONS

For users who download the aSeller mobile application from the Apple App Store or Google Play:

• This agreement is concluded between You and aSeller, not with Apple Inc. or Google LLC.
• To enable core POS capabilities, the application may request device permissions: (1) Bluetooth & Local Network access to connect thermal printers, (2) Camera access for barcode and QR code scanning, (3) Storage access to export Excel receipts, and (4) Internet access for real-time cloud synchronization. All permissions are activated only with your device-level approval.
• Offline Mode: aSeller features an Offline-First database allowing sales ringing and receipt printing even when disconnected. You acknowledge that cached local records will sync to cloud servers once an internet connection is re-established.

17. ACCOUNT AND DATA DELETION

To permanently delete your account and wipe all stored data:

1. Open the aSeller POS mobile application.
2. Navigate to Settings -> Delete Account.
3. Confirm the on-screen prompts.

Important Note: Account deletion is permanent and irrecoverable. All associated sales history, inventory catalogs, and customer records will be completely removed.
